Bribery risks and acts are a reality in any organization, be it multinational or local, big or small, public or private.
On April 4, 2018, the Malaysian Anti-Corruption Commission (Amendment) Bill 2018 was passed by the Parliament and subsequently by the Dewan Negara. One of the key amendment is the introduction of Section 17A “Offence by Commercial Organization”.
Under this new Section 17A, the commercial organization will be held liable for the corrupt practices carried out for the organization’s benefit or advantage, by its employees and/or persons associated with the organizations. The enforcement of Section 17A will be effective by June 1, 2020. Hence, all commercial organizations in Malaysia would have approximately one year to comply with this new regime of corporate liability in relation to corruption.
So, how can you proactively prevent bribery risks? With ISO 37001:2016, the Anti-Bribery Management System (ABMS) standard that guides organization in detecting, preventing and responding to bribery-related risks and acts. An organization certified to ISO 37001 sends a strong message to its customers, stakeholders, and other business associates that the organization has implemented a globally recognized good practice controls to prevent bribery and root out misbehavior.
